Rental Price: The weekly rental prices are payable in $US (US Dollars). These prices are fixed on the basis of the market situation as of November 2006; if this situation should undergo substantial changes, Tuscan Treasures reserves the right to modify prices. If the prices increase more than 5%, clients have the right to cancel the contract. The minimum rental period is one week, always from Saturday afternoon to Saturday morning..
Payment Terms: Payment must be made in $US (US dollars) by bank transfer (e.g. SWIFT), without any charges for the beneficiary . For each payment the name of the client, the booking number and the property reference must be clearly specified. If these conditions are not met, the booking is invalid. Payments in other currencies are not accepted. All prices quoted are normally "all included". Other additional charges not included in the rental price (e.g. extra linens, heating, etc.), which are clearly indicated in the descriptions must be paid directly to the owner or his representative before departure. Charges for use of telephone and domestic help (if applicable) must also be paid directly to the owner or his representative. Payments must be made according to the terms in the "How to Book" section below. Tuscan Treasures will cancel the booking if the above terms are not complied with.
How to Book: All bookings must be made directly through Tuscan Treasures or agencies which are authorized to act on behalf of Tuscan Treasures. These agencies can also accept payments from clients on behalf of Tuscan Treasures. The client must complete the booking form and return it duly signed; accepting all general conditions of rental. The contract is binding and with the signature the client becomes responsible for the rental from Tuscan Treasures according to U.S. law. The client must also give the names and passport information for all members of the party. A deposit of 30% (50% for Canada and the U.S.A.) of the total rental is due at the time the booking is confirmed. When the signed booking form and the initial deposit have been received, Tuscan Treasures will confirm the booking in writing. The balance is due no later than 65 days before the beginning of the rental period. However, if the balance is not paid within this time limit, Tuscan Treasures reserves the right to cancel the booking, in which case the deposit is forfeit. Full payment is required for bookings made within 60 days before the beginning of the rental period. The prices quoted are an integral part of the general conditions of rental; agents or distributors are not authorized to alter the prices in any way. After full payment has been received, Tuscan Treasures will send the client a rental voucher together with the address of the property, contact information, and directions for reaching it. Upon arrival the client must show the voucher, along with personal identification, to the owner or his representative before gaining admittance to the property. No other document will be accepted. The voucher is personal and valid only for the persons named on the booking form and is non-transferable. The owner or his representative will refuse entrance to the property if the number of persons exceeds that indicated on the voucher or if their identity documents (passports) do not match the information given when the booking was made. If the rental property allows them, children under two years are not counted, provided the clients bring their own baby cot and linen (possible exceptions are pointed out in the descriptions of the houses). If there is any change in the individual persons or the total number of persons during the stay, Tuscan Treasures must be informed in advance, otherwise the owner or his representative can request the whole party to leave, in which case the client forfeits the total rental. All changes must be agreed beforehand in writing with Tuscan Treasures.
Included in weekly rental price: electricity, cooking gas, heating (note: laws allow heating only between Nov. 15 and April 15 in most areas), hot water consumption and 1 weeks supply of clean bed linen and towels.
Excluded from price: air-conditioning, telephone calls, firewood, electric fans and supplementary maid or other services.
Arrival and Departure: Normal arrival time at the property is between 4:30pm and 7pm (16:30-19:00 local time) on Saturday afternoon. Permission to arrive outside those hours will only be given in extreme circumstances, and must be arranged for at least 1 week (7 days) prior to client's arrival. If your flight is delayed or you are held up for other reasons, it is essential that you call the contact number on your voucher to advise us. Departure from the property must not be later than 10am (10:00 local time) Saturday.
Security Deposit: The security deposit should be paid with the rental balance, or on arrival at the property (see booking form). This is the owner's guarantee that any valuable furniture, objets d'art, books, paintings, decorations and general household furnishings and equipment will be treated with due care and respect. It is the client's responsibility to advise the owner or caretaker of any damage, however small, at the end of your stay. The security deposit will be reimbursed within 15 days of departure after the caretaker or owner has deducted the cost of repairs or replacement for damage to the property or its contents that might occur during the stay. If the cost of repairs or replacement is greater than the security deposit, the excess amount will be invoiced to the client and the security deposit will not be reimbursed.
Extra services (where available): (some of these services require partial payment upon making the booking) maid / cook / babysitter / airport collection / van or minibus with driver / scooter and mountain bike hire, etc.
Pets: Domestic animals must not be brought to the property under any circumstances.
Smoking: Please check each listing; for some rentals, smoking is not allowed under any circumstances inside the house.
Maintenance: The owner or his representative reserve the right of entering the property for essential maintenance (appliances, heater, etc.) even for totally independent houses.
Final Cleaning: On arrival the client will find the property in a clean and tidy condition and must leave it in the same way on departure, otherwise the owner or his representative has the right to deduct 30,00 per person from the security deposit with a minimum of 100,00 per house. If the price of the final cleaning is specified in the description and price quotation, clients must pay it in any case. Clients are requested to leave the property clean and tidy on their departure (fridge empty, pots, pans, tableware, & oven cleaned, garbage taken away, beds stripped, kitchen and bathrooms cleaned). If the client does not do so , the relevant cleaning costs will be deducted from the security deposit.
Behavior: The client signing the contract is responsible for the correct behavior of the client's party while occupying the property. Should a member of the party fail to behave in a civilized and decent manner, the owner or his representative has the right to ask the party to leave immediately and for compensation of all damages caused. The rental is automatically forfeit, and the client shall not receive any reimbursement.
Complaints: The descriptions of the properties are made in good faith. Tuscan Treasures cannot be held responsible for alterations which may have been carried out by the owner of the property without informing Tuscan Treasures. All efforts are made by Tuscan Treasures to ensure that the property booked is in excellent condition and fully functional prior to the client's arrival. But should any of the domestic systems or appliances malfunction during the stay, repairs will be carried out as soon as possible. If the client has cause for complaint, he should inform Tuscan Treasures on the arrival day, Saturday, no later than 8:30 pm (20:30) or before 12:00 noon on the following Monday, confirming it in writing within 24 hours. No complaint can be taken into consideration and no refund will be considered unless this procedure is observed. Tuscan Treasures reserves the right to verify during the period of occupancy the causes of complaint, inspecting the property if necessary. If the client vacates the property before the Tuscan Treasures representative arrives, the client will forfeit the right to any compensation. Tuscan Treasures will not accept as causes for complaint weather conditions, stings/bitings or presence of insects, lack of water , electricity, telephone, gas, work in progress, etc., if beyond the control of Tuscan Treasures or the owner or caused by outside agencies (e.g. government agencies, services providers, acts of God, or third parties, etc.). Further, Tuscan Treasures does not accept liability for events beyond its control such as breakdowns, leaks, power cuts, water shortages, floods, storm damage, earthquakes, strikes, civil uprisings, acts of terrorism or force majeur.
Cancellation by Client: Cancellation of the booking must be notified to Tuscan Treasures in writing. If you cancel your booking up to 60 days before the date of arrival on the property, the cancellation charge is 30% of the total rental price specified in the Booking Form. If your cancellation is made between 60 and 45 days before the date of arrival on the property, the charge is 50% of the total rental price specified in the Booking Form. If your cancellation is made less than 45 days before the date of arrival on the property, the charge is 100% of the total rental price specified in the Booking Form. Any charges incurred by Tuscan Treasures in the above reimbursements (e.g. costs of wire transfers) due to cancellation will be deducted from the reimbursement due. Tuscan Treasures will not reduce or waive these terms in the event of circumstances beyond its control such as illness, injury or death, flight cancellations, war, civil uprisings, terrorist attacks, labor strikes, earthquakes, floods, storm damage or force majeur.
Travel Insurance: Tuscan Treasures does not provide or promote travel insurance on behalf of its clients. You are strongly advised to make the necessary arrangements with a reliable insurance company to cover all stages of the holiday including flight or transport cancellations as well as for cancellation of the rental booking.
Cancellation by Tuscan Treasures: If, for reasons beyond our control, we are forced to cancel the booking , we will undertake to find a suitable alternative or give you a total refund of all monies paid to date.
Jurisdiction: For any dispute concerning terms and conditions of this contract, booking and letting, etc. only the Court of Law of California (USA) will have jurisdiction. USA Law must be applied. Tuscan Treasures' responsibility is only bound to the rules for estate agencies. If some of the conditions of this contract should be modified by new laws, the validity of the remaining conditions remain inviolate.
These conditions are accepted in their entirety by the client and all members of the rental party upon signature of the Booking Form.
